Return Policy: Return, Refund & Warranty Policy
This Return, Refund & Warranty Policy (“Policy”) governs all transactions, products, and services supplied by Pro Tread Tyres (Pty) Ltd (“the Company”, “we”, “us”, “our”). By purchasing from us, the customer (“the Customer”, “you”, “your”) agrees to be bound by this Policy.
This Policy must be read together with applicable South African legislation, including but not limited to the Consumer Protection Act 68 of 2008 (CPA). Where any provision of this Policy conflicts with the CPA, the CPA shall prevail.
1. General Terms
1.1 All return, refund, or warranty claims must be submitted in writing within 7 (seven) calendar days of purchase or service completion, unless otherwise required by law.
1.2 No goods will be accepted for return without prior approval from the Company.
1.3 The Company reserves the right to refuse any return that does not strictly comply with this Policy.
1.4 A valid original invoice must be presented for all claims.
2. Serial Number Control & Proof of Product Identity
2.1 All tyres sold by the Company are recorded and invoiced with a unique tyre serial number.
2.2 The Customer acknowledges and agrees that:
The serial number on the tyre must exactly match the serial number reflected on the invoice
Any mismatch, tampering, removal, or illegibility of the serial number will automatically void any return, refund, or warranty claim
2.3 The Company reserves the right to reject any claim where product identity cannot be verified beyond reasonable doubt.
3. Returns – Tyres
3.1 Tyres will only be considered for return if:
They are unused, unfitted, and undamaged
They are returned in their original condition
All identifying marks, including serial numbers, are intact and verifiable
The return is requested within 7 (seven) days
3.2 The following items are strictly non-returnable:
Tyres that have been fitted, mounted, inflated, or used in any way
Special-order, imported, or custom-sourced tyres
Used tyres sold on an “as-is” basis
Clearance or discounted stock (unless defective as per CPA)
4. Manufacturing Defects & Warranty Claims
4.1 Any allegation of a manufacturing defect shall be subject to a mandatory inspection process, which may include inspection by:
The Company
The manufacturer
An independent third-party specialist
4.2 Conditions for assessment:
The tyre must be made available for inspection at a location determined by the Company
The serial number must be clearly visible and must match the invoice
The Customer must provide full usage history if requested
4.3 Outcome of inspection:
If a manufacturing defect is confirmed, the Company may, at its sole discretion:
Repair the product
Replace the product
Provide a pro-rata refund, taking into account wear and usage
4.4 The following are explicitly excluded from manufacturing defects:
Road hazards (cuts, punctures, impacts)
Incorrect inflation or pressure maintenance
Overloading or improper load distribution
Misalignment, suspension faults, or mechanical defects
Improper fitment or installation by third parties
Negligence, misuse, or abnormal operating conditions
4.5 The Company’s decision, supported by inspection findings, shall be final and binding, subject only to rights afforded under the CPA.
5. Rim Returns
5.1 Truck rims may only be returned if:
They are unused and not fitted
Returned within 7 (seven) days
In original condition with proof of purchase
5.2 Fitted or used rims are non-returnable, unless a verified manufacturing defect exists.
6. Services (Fitment, Repairs, Regrooving, Retreading)
6.1 All services are deemed accepted as complete and satisfactory upon completion, unless reported otherwise within 48 (forty-eight) hours.
6.2 The Company’s liability for defective workmanship is strictly limited to:
Re-performance of the service, or
Rectification of the specific issue identified
6.3 Under no circumstances shall the Company be liable for:
Indirect, consequential, or economic losses
Downtime, loss of income, or business interruption
Damage arising after the vehicle leaves our control
7. On-Site, Mobile & Emergency Services
7.1 All call-out, mobile, and emergency service fees are non-refundable under any circumstances.
7.2 Products fitted on-site are subject to the same terms as in-store purchases.
8. Collection, Delivery & Associated Costs
8.1 Where collection of goods is required:
A collection fee will be charged, based on distance, vehicle usage, and logistics
Such fees are non-refundable, irrespective of claim outcome
8.2 The Customer bears all risk in returning goods to the Company unless otherwise agreed in writing.
9. Refunds
9.1 Refunds will only be processed where required under the CPA or where approved at the Company’s discretion.
9.2 Approved refunds:
May be subject to inspection outcomes and usage deductions
Will be processed within 5–10 business days
Will be issued via the original payment method, unless otherwise agreed
10. Exchanges
10.1 Exchanges are subject to:
Product availability
Inspection and approval
Compliance with all return conditions
11. Limitation of Liability
11.1 To the fullest extent permitted by law, the Company shall not be liable for:
Any indirect, incidental, special, or consequential damages
Loss of profits, contracts, or business opportunities
Any damage resulting from misuse, improper maintenance, or external factors beyond our control
11.2 The Company’s total liability, where applicable, shall not exceed the original purchase price of the product or service in question.
12. Indemnity
The Customer agrees to indemnify and hold harmless Pro Tread Tyres (Pty) Ltd, its directors, employees, and agents against any claims, damages, losses, or expenses arising from:
Improper use of products
Failure to follow recommended guidelines
Third-party actions or installations
13. Policy Amendments
The Company reserves the right to amend this Policy at any time without prior notice. The latest version published on our website shall apply.
14. Governing Law
This Policy shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
